A menhelyenazélet.com üzemeltetője ezúton tájékoztatja a Weboldal (a továbbiakban: Weboldal) látogatóit a személyes adatok kezelése körében követett gyakorlatáról, az adatok védelme érdekében megtett szervezési és technikai intézkedéseiről, valamint a látogatók ezzel kapcsolatos jogairól, és azok érvényesítésének lehetőségeiről.

Az adatok kezelője Annaházi Katalin (a továbbiakban: Üzemeltető).

Amennyiben az Üzemeltető a Weboldal látogatójától (továbbiakban: Felhasználó) bármilyen célra személyes adatokat kér, az alábbi rendelkezések az irányadók.

Jelen Adatvédelmi nyilatkozat az Üzemeltető Weboldala használatakor a Felhasználó esetlegesen megadott személyes adatainak kezelésére, feldolgozására, nyilvántartására vonatkozó alapvető információkat tartalmazza.

Az Adatvédelmi nyilatkozat bármikor módosításra kerülhet, a Felhasználó köteles időről időre ellenőrizni a Weboldalt, biztosítandó, hogy az esetleges változásokról tudomással bírjon. Az Adatvédelmi nyilatkozat 2019. Január 1. napján lépett hatályba. A Weboldalon megadott személyes adatainak kezelésért az Üzemeltető felelős.

ADATKÉRÉS ÉS COOKIE-K

A Weboldal használatához a Felhasználónak általában semmilyen adatot nem kell megadnia. Bizonyos szolgáltatások igénybevételéhez azonban szükséges lehet, hogy meghatározott személyes adatait az Üzemeltető rendelkezésére bocsássa.

Aza dott esettől függően az alábbi személyes adatokra lehet az Üzemeltetőnek szüksége:

név és elérhetőség, beleértve az e-mail címet, lakcímet valamint  esetlegesen a vállalatára vonatkozó adatok, az elérhetőségekre vonatkozó preferenciák, hogy további információkat tudjak nyújtani egy esetleges témáról, projectről.

A cookie-k a böngészésre használt eszközének paramétereiről, annak böngészőjéről, valamint az Te esetleges beállításadiról, korábbi látogatásaidról tárolhatnak információkat, hogy ezáltal is jobb felhasználói élményt tudjak nyújtani Neked.

Ezen túl a weboldal cookie-kat, azaz sütiket helyezhet el a Felhasználó böngészésre használt eszközén, amennyiben ezt Te kifejezetten jóváhagyod a weboldalra való első belépéskor. Tudod, amikor rákattintasz arra, hogy elfogadod a sütiket! Fontos, hogy ezek a cookie-k nem az Üzemeltetőnél, hanem a Felhasználó böngészésre használt saját eszközén kerülnek elhelyezésre, így a felhasználó az, aki teljes mértékben rendelkezik felettük.

A KEZELT ADATOK KÖRE

A Weboldal megtekintése során, a Felhasználó gépén elhelyezett cookie-k használata segítségével automatikusan rögzítésre kerülhet a Felhasználó látogatásának kezdő és befejező időpontja, IP-címe, illetve egyes esetekben – a Felhasználó számítógépének beállításától függően – a böngésző, az operációs rendszer típusa, nyelve, a Felhasználó eszközének paraméterei, a felhasználó által a Weboldalon megadott beállítások, a meglátogatott aloldalak és az azokon eltöltött idő. Az Üzemeltető ezen adatokat nem kapcsolja össze és nem is tudja összekapcsolni személyes adatokkal, ezek megosztásáról Te döntesz a részemre adott kifejezett felhatalmazással, valamint a böngésződben megadott cookie-beállításaival.

A Weboldal használatához megadott egyéb adatok kezelése is a felhasználó önkéntes hozzájárulásával történik.

AZ ADATKEZELÉS CÉLJA

Az adatkezelés a Weboldal szolgáltatásait igénybevevő regisztrált Felhasználók és az Üzemeltető közötti folyamatos kapcsolatot, a felhasználói élmény javítását, valamint a közvéleménykutatást szolgálja. A cookie-k használata révén a rendszer automatikusan statisztikai adatokat generál a látogatás időtartamáról, a meglátogatott oldalakról annak érdekében, hogy a Weboldal tartalmát és szolgltatásait az Üzemeltető tovább tudja fejleszteni, optimalizálni, még inkább a Felhasználó igényeire szabni. Az Üzemeltető a cookie-kat arra is felhasználja, hogy a következő látogatás során a Felhasználó korábbi tevékenységével összhangban lévő tartalmat nyújtsa a Felhasználó számára, automatikusan be tudja tölteni annak saját beállításait, így kényelmesebbé téve a weboldal használatát.

A felhasználó által megadott egyéb adatokat az Üzemeltető kizárólag abból a célból használja és kezeli, hogy magasabb szintű szolgáltatást tudjon a Felhasználó részére nyújtani, különösen az alábbi területeken:

-a Weboldalon feltett kérdéseire történő válaszadáshoz;

– hírleveleink eljuttatásához;

– belső nyilvántartásához;

– a Weboldal tartalmának fejlesztéséhez;

– a Weboldal frissítéséről történő tájékoztatáshoz;

– a Weboldal tartalmának testre szabásához;

A kapcsolatot az Üzemeltető, vagyis én csak úgy vehetem fel Veled, Felhazsnálóval a kapcsolatot, ha Te az ehhez szükséges adatodat megadod (telefonszám, e-mail cím, postai cím, stb) és ha ezekhez hozzájárulsz! Az Üzemeltető a megjelölt céloktól eltérő célra a személyes adatokat nem használja. Az így megadott adatok kezelése a Felhasználó önkéntes hozzájárulásával történik.

Az Üzemeltető a Felhasználókra vonatkozó valamennyi adatot és tényt bizalmasan kezeli, azokat kizárólag a szolgáltatásai fejlesztéséhez és saját statisztika készítéséhez használja fel. Az ezekről készült kimutatások esetleges publikálása csak olyan formában történik, amely nem alkalmas az egyes Felhasználók egyedi beazonosítására.

Személyes adatait hozzájárulása nélkül az Üzemeltető nem továbbítja, nem teszi közzé, nem adja el, illetve nem adja bérbe és harmadik személy részére nem teszi hozzáférhetővé, kivéve, ha azt jogszabály írja elő.

AZ ADATKEZELÉS IDŐTARTAMA

A session ID-k a Weboldal elhagyásakor automatikusan törlődnek, ugyanakkor a cookie-k egy másik része abban nyújt segítséget az Üzemeltető számára, hogy használatuk révén az Üzemeltető tisztában legyen a Felhasználó korábbi beállításaival, az általa megadott adatokkal, információkkal, weboldalhasználatának egyéb jellemzőivel, hogy azokat a következő látogatáskor ne kelljen ismét megadnia, valamint beállításai automatikusan betöltődjenek egy kellemesebb felhasználó élmény elérése érdekében. Ezeknek a cookie-knak a lejárati ideje változó, de jellemzően addig vannak jelen a Felhasználó eszközén, ameddig azokat a Felhasználó nem törli.

Az Üzemeltető részére írt üzenetek az Üzemeltető saját belátása szerint osztályozza, és amennyiben úgy ítéli meg, hogy annak tartalma az Üzemeltető vagy más harmadik személy jogos érdekének védelméhez vagy ilyen érvényesítéséhez szükséges, úgy azokat 5 évig eltárolja, de szigorúan csak a fentebb említett célból használja fel. Amennyiben ilyen jelentőséget nem tulajdonít Üzemeltető az üzenetnek, úgy azt a beérkezést követő 30 napon belül törli.

Az Üzemeltető nem vállal felelősséget a már törölt, de az internetes keresőprogramok közreműködésével mégis archiválásra került, korábbi oldalaiért. Ezek eltávolításáról a keresőoldal működtetőjének kell gondoskodni.

AZ ADATOKHOZ HOZZÁFÉRŐK KÖRE, ADATFELDOLGOZÓK

A Felhasználók által megadott személyes adatokhoz csak az Üzemeltető és az ő munkatársai férhetnek hozzá.

Személyes adatokat a megjelölteken kívül harmadik személyeknek az Üzemeltető nem ad át. Ez nem vonatkozik az esetleges, törvényben előírt, kötelező adattovábbításokra, amelyekre csak rendkívüli esetekben kerülhet sor. Az Üzemeltető az egyes hatósági adatkérések teljesítése előtt minden egyes adat tekintetében megvizsgálja, hogy valóban fennáll-e az adattovábbítás jogalapja.

A FELHASZNÁLÓK SZEMÉLYES ADATAIK KEZELÉSÉVEL KAPCSOLATOS JOGAI, AZ ADATTÖRLÉS

Az adatkezelés jogalapja a Felhasználók önkéntes hozzájárulása. Személyes adataik kezeléséről a Felhasználók tájékoztatást kérhetnek. Az Üzemeltető kérésre tájékoztatást ad az érintettnek az általa kezelt adatairól, az adatkezelés céljáról, jogalapjáról, időtartamáról, az Üzemeltető nevéről, címéről és az adatkezeléssel összefüggő tevékenységéről, továbbá arról, hogy kik és milyen célból kapják vagy kapták meg az adatokat. A tájékoztatás az Üzemeltető info@menhelyenazelet.com e-mail címen kérhető. Ugyanezeken az elérhetőségeken kezdeményezheti a Felhasználó személyes adatainak helyesbítését és törlését is.

A Weboldal szolgáltatásainak nem megfelelő igénybevétele esetén, valamint a Felhasználó saját kérésére a hozzá tartozó adatokat törlöm. A törlésre a törlési igény megkezdésétől számított következő munkanapot követő 24 órán belül kerül sor.

Személyes adataid biztonságára nagy hangsúlyt fektetek. Azért, hogy megakadályozzuk a személyes adatokhoz történő jogosulatlan hozzáférést, megfelelő fizikai, elektronikus eljárást alkalmazunk az online beérkezett adatok védelméért és biztonságáért.

Amennyiben a Weboldallal kapcsolatos cookie-beállításain kívánsz módosítani, esetleg azokat törölni szeretnéd, akkor azt – mivel a cookie-k a felhasználó gépén és nem a Weboldal Üzemeltetőjénél kerülnek tárolásra – a web elérésére használt böngésző beállításainál teheted meg. Ezekről az általad használt böngésző saját Súgójában kaphatsz további tájékoztatást, és segítségével módosíthatod korábbi cookie-beállításaidat, esetleg törölheted a böngészésre használt eszközön a korábban az Üzemeltető által elhelyezett cookie-kat.

AZ ÉRINTETTEK JOGAI, JOGORVOSLATI LEHETŐSÉGEK

(1) Az érintettek bármikor tájékoztatást kérhetnek írásban az Adatkezelőtől az általa kezelt személyes adataik kezelésének módjáról, jelezheti törlési vagy módosítási igényét, továbbá visszavonhatja a korábban megadott hozzájárulását a 3. pontban megadott elérhetőségeken.

(2) Az érintett törlési jogát a jogszabályban kötelezően előírt adatkezelések esetén nem gyakorolhatja.

(3) A tájékoztatáshoz való jog tartalma: Az érintett igénye alapján az Adatkezelő az érintett részére a személyes adatok kezelésére vonatkozó, a GDPR 13. és 14. cikkében felsorolt információkat, valamint a 15-22. és a 34. cikk szerinti tájékoztatásokat tömör, közérthető formában átadja.

(4) A hozzáféréshez való jog tartalma: Az érintett megkeresésére az Adatkezelő tájékoztatást nyújt arról, hogy folyamatban van-e rá vonatkozó adatkezelés az Adatkezelőnél. Amennyiben Adatkezelőnél folyamatban van a kérelmezőre vonatkozó adatkezelés, az érintett jogosult hozzáférésre a következők tekintetében:

A rá vonatkozó személyes adatok;

– az adatkezelés célja(i);

– az érintett személyes adatok kategóriái;

– azon személyek, amelyekkel az érintett adatait közölték, vagy közölni fogják;

– az adatok tárolásának időtartama;

– a helyesbítéshez, törléshez, valamint az adatkezelés korlátozásához való jog;

– a bírósághoz, illetve felügyeleti hatósághoz fordulás joga;

– a kezelt adatok forrása;

– profilalkotás és/vagy automatizált döntéshozatal, illetve ilyen alkalmazásának részletei, gyakorlati hatásai;

– a kezelt adatok harmadik országos vagy nemzetközi szervezet részére való átadása.

(5) A fentiek szerinti adatigénylés esetén Adatkezelő az érintett részére kiadja a kérelemnek megfelelő, általa kezelt adatok egy másolati példányát. Külön kérelemre van lehetőség elektronikus úton való kézbesítést kérni az Adatkezelőtől.

(7) Az igényelt adatok kiadásának határideje az igény átvételétől számított 30 nap.

(8) A helyesbítéshez való jog: Az érintett kérheti az Adatkezelő által kezelt, rá vonatkozó pontatlan adatok helyesbítését.

(9) A törléshez való jog: Amennyiben az alábbi indokok bármelyike fennáll, úgy az érintett kérésére Adatkezelő a legrövidebb időn belül, de legkésőbb 5 munkanapon belül, törli az érintettre vonatkozó adatokat:

– Az adatok jogellenesen (jogszabályi felhatalmazás vagy személyes hozzájárulás nélkül) kerültek kezelésre;

– az adatok kezelése szükségtelen az eredeti cél megvalósításához;

– az érintett visszavonja hozzájárulását az adatkezeléshez, és az Adatkezelőnek nincs más jogalapja az adatkezelésre;

– a kérdéses adatok gyűjtésére információs társadalommal összefüggő szolgáltatások kínálásával kapcsolatban került sor;

– a személyes adatokat az Adatkezelőre vonatkozó jogszabályi kötelezettségek teljesítéséhez törölni kell.

(10) Az adatok törlését Adatkezelőnek nem áll módjában elvégezni, ha az adatkezelés az alábbiak bármelyikéhez szükséges a továbbiakban is:

– Az Adatkezelőre vonatkozó jogszabályi előírások teljesítéséhez szükséges a további adatkezelés;

– a véleménynyilvánításhoz és a tájékozódáshoz való jog gyakorlása céljából szükséges;

– közérdekből;

– archiválási, tudományos, kutatási vagy statisztikai célból;

– jogi igények érvényesítéséhez vagy védéséhez.

(11) Az adatkezelés korlátozásához való jog: Amennyiben az alábbi indokok bármelyike fennáll, Adatkezelő korlátozza az adatkezelést az érintett kérelmére:

– Az érintett vitatja a rá vonatkozó adatok pontosságát, ekkor a korlátozás arra az időre vonatkozik, ameddig a kérdéses adatok pontosságának, helyességének felülvizsgálata hitelt érdemlően megtörténik;

– az adatkezelés jogellenes, ugyanakkor az érintett kéri a törlés mellőzését, csupán az adatkezelés korlátozását kéri;

– az adatkezeléshez már nincs szükség az adatokra, de az érintett kéri azok további tárolását jogi igényei érvényesítéséhez vagy megvédéséhez;

(12) Amennyiben az Adatkezelő korlátozást vezet be bármely kezelt adatra, úgy a korlátozás időtartama alatt kizárólag akkor, és annyiban kezeli az érintett adatot, amennyiben:

Az érintett ehhez hozzájárul;

– jogi igények érvényesítéséhez vagy megvédéséhez szükséges;

– más személy jogainak érvényesítéséhez vagy megvédéséhez szükséges;

– közérdek érvényesítéséhez szükséges.

(13) A visszavonáshoz való jog: Az érintett jogosult az Adatkezelőnek adott hozzájárulását – írásban – bármikor visszavonni. Ilyen igény esetén az Adatkezelő haladéktalanul és véglegesen törli mindazon adatokat, amelyeket az érintettel kapcsolatosan kezelt, és amelyek további tárolását jogszabály nem írja elő, vagy jogos érdekekhez fűződő jogok érvényesítéséhez vagy megvédéséhez nem szükségesek. A hozzájárulás visszavonásáig történt adatkezelés jogosságát a visszavonás nem érinti.

(14) Az adathordozáshoz való jog: Az érintett jogosult az Adatkezelő által a rá vonatkozó adatok, általánosan használt, számítógépes szoftverrel olvasható formátumban történő továbbítását kérni egy másik adatkezelő részére. A kérést Adatkezelő a lehető legrövidebb időn belül, de legkésőbb 30 napon belül teljesíti.

(15) Automatizált döntéshozatal és profilalkotás: Az érintettet megilleti a jogosultság, hogy ne legyen alanya kizárólag automatizált adatkezelésen (például profilalkotáson) alapuló olyan döntésnek, amely rá joghatással lenne, vagy egyébként hátrányosan érintené. Nem alkalmazható ezen jogosultság, ha:

– az adatkezelés elengedhetetlen az érintett és az Adatkezelő közötti szerződés megkötése vagy teljesítése céljából;

– az érintett kifejezetten hozzájárul ilyen eljárás alkalmazásához;

– alkalmazását jogszabály engedélyezi;

– szükséges jogi igények érvényesítéséhez vagy védéséhez.

JOGÉRVÉNYESÍTÉSI LEHETŐSÉGEK

Az a Felhasználó, aki úgy érzi, hogy az Üzemeltető megsértette a személyes adatok védelméhez való jogát, igényét polgári bíróság előtt érvényesítheti, vagy kérheti a Nemzeti Adatvédelmi és Információszabadság Hatóság (NAIH) segítségét is. Az erre, valamint az Üzemeltető kötelezettségeire vonatkozó részletes törvényi rendelkezéseket a személyes adatok védelméről és a közérdekű adatok nyilvánosságáról szóló 2011. évi CXII. törvény, valamint az Európai Parlament és a Tanács (EU) 2016/679 rendelete (GDPR) tartalmazza.

TÁJÉKOZTATÁS A MAGÁNSZFÉRÁT FENYEGETŐ VESZÉLYEKRŐL

Az Internet használatával együtt járnak különböző, a magánszférát fenyegető veszélyek.

Relevant Legal Background

In accordance with Art. 13 GDPR, we inform you of the legal basis of our data processing. If the legal basis is not stated in the data protection declaration, the following applies: The legal basis for obtaining consents is Art. 6 Para. 1 lit. a and Art. 7 GDPR, the legal basis for processing for the purpose of fulfilling our services and implementing contractual measures and answering enquiries is Art. 6 Para. 1 lit. b GDPR, the legal basis for processing for the purpose of fulfilling our legal obligations is Art. 6 Para. 1 lit. c GDPR, and the legal basis for processing for the purpose of safeguarding our legitimate interests is Art. 6 Para. 1 lit. f GDPR. In the event that vital interests of the data subject or another person require the processing of personal data, Article 6 paragraph 1 lit. d GDPR serves as the legal basis.

Cooperation with Processors and Third Parties

If, in the course of our processing, we disclose data to other persons and companies (processors or third parties), transfer it to them or otherwise grant them access to the data, this will only be done on the basis of a legal authorisation (e.g. if the data must be transferred to third parties, such as payment service providers, in accordance with Art. 6 Para. 1 letter b GDPR for the fulfilment of the contract), if you have given your consent, if a legal obligation provides for this or on the basis of our legitimate interests (e.g. when using agents, website).

If we commission third parties to process data on the basis of a so-called “contract processing agreement,” this is done on the basis of Art. 28 GDPR.

Transfers to Non-Member Countries

If we process data in a non-member country (i.e. outside the European Union (EU) or the European Economic Area (EEA)), or if this is done in the context of using the services of third parties or disclosure or transfer of data to third parties, this will only take place if it is done to fulfil our (pre-)contractual obligations, on the basis of your consent, on the basis of a legal obligation or on the basis of our legitimate interests. Subject to legal or contractual permissions, we will only process or transfer data to a third country in accordance with the special requirements of Art. 44 ff. GDPR. In other words, processing is carried out, for example, on the basis of special conditions, such as the officially recognised determination of a level of data protection corresponding to that of the EU (e.g. for the USA through the ” Data Protection Shield”) or compliance with officially recognised special contractual obligations (so-called “standard contractual clauses”).

Users’ Rights

You have the right to request confirmation as to whether or not data in question is being processed and to obtain information about this data and to receive further information and a copy of the data in accordance with Art. 15 GDPR.

Consequently, in accordance with Art. Art. 16 GDPR, you have the right to request the completion of data pertaining to you or the correction of incorrect data pertaining to you.

Under Art. 17 GDPR, you have the right to demand that data concerning you be deleted immediately, or alternatively, under Art. 18 GDPR, to demand that the processing of the data be restricted.

You have the right to request that the data concerning you which you have made available to us be received in accordance with Art. 20 GDPR and to demand that it be passed on to other responsible parties.

You also have the right to lodge a complaint with the competent supervisory authority in accordance with Art. 77 GDPR.

Right of Revocation

You have the right to revoke any consent you have given in accordance with Art. 7 Para. 3 GDPR with immediate effect

Right of Objection

You can object to the future processing of data concerning you at any time in accordance with Art. 21 GDPR. In particular, you may object to processing for the purposes of direct advertising.

Cookies and Right of Objection for Direct Advertising

“Cookies” are small files that are stored on the user’s computer. Different information can be stored within the cookies. A cookie is primarily used to store information about a user (or the device on which the cookie is stored) during or after his visit to an online offer. Temporary cookies, or “session cookies” or “transient cookies,” are cookies that are deleted after a user leaves an online offer and closes his browser. The data processed by us will be deleted or restricted in its processing in accordance with articles 17 and 18 GDPR. Unless expressly stated within the scope of this data protection declaration, the data stored by us will be deleted as soon as it is no longer required for its intended purpose and the deletion does not conflict with any statutory storage obligations. If the data is not deleted because it is required for other and legally permissible purposes, its processing is restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons.

According to legal requirements in Germany, data is stored in particular for 6 years in accordance with § 257 Paragraph 1 HGB (commercial books, inventories, opening balance sheets, annual financial statements, commercial letters, accounting vouchers, etc.) and for 10 years in accordance with § 147 Paragraph 1 AO (books, records, management reports, accounting vouchers, commercial and business letters, documents relevant for taxation, etc.).

Hosting

The hosting services we use serve to provide the following services: Infrastructure and platform services, computing capacity, storage space and database services, security services as well as technical maintenance services which we use for the purpose of operating this online offer.

For this purpose, we or our hosting provider process inventory data, contact data, content data, contract data, usage data, meta and communication data of customers, interested parties and visitors of this online offer on the basis of our legitimate interests in an efficient and secure provision of this online offer in accordance with Art. 6 para. 1 lit. f GDPR in conjunction with Art. 28 GDPR (conclusion of contract processing agreement).

Collection of Access Data and Log Files

We, or our hosting provider, on the basis of our legitimate interests as defined in Art. 6 para. 1 lit. f. GDPR data concerning every access to the server on which this service is located (so-called server log files). The access data includes the name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user’s operating system, referrer URL (the previously visited site), IP address and the requesting provider.

Log file information is stored for security reasons (e.g. to clarify misuse or fraud) for a maximum of 3 months and then deleted. Data whose further storage is required for evidential purposes is excluded from deletion until such time as the respective incident has been resolved.

Contractually Agreed Services

We process inventory data (e.g., names and addresses as well as contact data of users), contract data (e.g., services used, names of contact persons, payment information) for the purpose of fulfilling our contractual obligations and services in accordance with Art. 6 para. 1 lit b. GDPR. The entries marked as obligatory in online forms are required for the completion of the contract.

When using our online services, we store the IP address and the time of the respective user activity. The storage is based on our legitimate interests, as well as the user’s protection against misuse and other unauthorized use. This data is not passed on to third parties unless it is necessary to pursue our claims or there is a legal obligation to do so in accordance with Art. 6 Para. 1 lit. c GDPR.

We process usage data (e.g., the websites visited by our online offer, interest in our products) and content data (e.g., entries in the contact form or user profile) for advertising purposes in a user profile in order to show the user, for example, product information based on the services they have used so far.

The deletion of the data is carried out after the expiry of legal warranty and comparable obligations, the necessity for the storage of the data is reviewed every three years; in the case of legal archiving obligations, the deletion is carried out after their expiry. Details contained in any customer account shall remain in place until it is deleted.

Amazon Partner Program

We are entitled to make use of our online offer on the basis of our legitimate interests (i.e. interest in the economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f. GDPR), we are participants in the Amazon EU partner programme, which was designed to provide a means for websites to earn reimbursement of advertising costs by placing advertisements and links to Amazon.de (so-called affiliate system). Amazon uses cookies to track the origin of orders. Among other things, Amazon can recognize that you clicked the affiliate link on this website and then purchased a product from Amazon.

Registration Function

Users can optionally create a user account. During the registration process, the required mandatory data will be provided to the users. The data entered during registration is used for the purpose of accessing the website. Users can be informed by e-mail about information relevant to the offer or registration, such as changes in the scope of the services or technical difficulties. If users have terminated their account, their data with regard to the account will be deleted, subject to its retention is for commercial or tax law reasons according to Art. 6 para. 1 lit. c GDPR. It is the users’ responsibility to save their data before the end of the contract if they have terminated it. We are entitled to permanently delete all user data stored during the term of the contract.

As part of the use of our registration and login functions as well as the use of the user account, we store the IP address and the time of the respective user activity. The storage is based on our legitimate interests, as well as the user’s protection against misuse and other unauthorized use. This data will not be passed on to third parties unless it is necessary to pursue our claims or there is a legal obligation to do so in accordance with Art. 6 Para. 1 lit. c GDPR. The IP addresses are anonymised or deleted after 7 days at the latest.

Contact

When contacting us (e.g. via contact form, e-mail, telephone, Skype, WhatsApp or via social media), the user’s details are processed for the purpose of handling the contact request and its processing in accordance with Art. 6 Para. 1 lit. b) GDPR. The user’s details may be stored in a customer relationship management system (“CRM system”) or comparable inquiry management system.

We delete the inquiries if they are no longer required. We review the necessity every two years; furthermore, the statutory archiving obligations apply.

Comments and Contributions

If users leave comments or other contributions, their IP addresses will be deleted on the basis of our legitimate interests within the meaning of Art. 6 para. 1 lit. f. GDPR for 7 days. This is done for our security in case someone leaves illegal content in comments and contributions (insults, prohibited political propaganda, etc.). In this case we can be prosecuted for the comment or contribution ourselves and are therefore entitled to know the identity of the author.

Newsletter

With the following notes we would like to inform you about the contents of our newsletter as well as the registration, dispatch and statistical evaluation procedure and your right of objection. By subscribing to our newsletter, you agree to receive it and to the procedures outlined.

Content of the newsletter: We send newsletters, e-mails and other electronic notifications containing advertising information (hereinafter “newsletter”) only with the consent of the recipients or a legal permit. If, in the course of registering for the newsletter, its contents are specifically described, they are relevant for the consent of the users. Furthermore, our newsletters contain information about our services and us.

Double-Opt-In and logging: The registration for our newsletter is done in a so-called Double-Opt-In procedure. This means that after registration you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that nobody can register with foreign e-mail addresses. The registrations for the newsletter are logged in order to be able to prove the registration process according to the legal requirements. Germany: The dispatch of the newsletter and the associated measurement of success is based on the consent of the recipients in accordance with Art. 6 Para. 1 lit. a, Art. 7 GDPR in conjunction with § 7 Para. 2 No. 3 UWG or on the basis of legal permission in accordance with § 7 Para. 3 UWG.

The registration procedure is recorded on the basis of our legitimate interests pursuant to Art. 6 Para. 1 lit. f GDPR. We are interested in the use of a user-friendly and secure newsletter system that serves our business interests as well as the expectations of the users and also allows us to prove consent.

Cancellation/revocation – You can cancel the receipt of our newsletter at any time, i.e. revoke your consent. A link to cancel the newsletter can be found at the end of each newsletter. We may store the unsubscribed e-mail addresses for up to three years on the basis of our legitimate interests before we delete them for the purpose of sending the newsletter, in order to be able to prove a previously given consent. The processing of this data is limited to the purpose of a possible defence against claims. An individual request for deletion is possible at any time, provided that the former existence of a consent is confirmed at the same time.

Newsletter – Dispatch Service Provider

Newsletters are sent by the “ActiveCampaign” mailing service, a newsletter mailing platform of the US provider ActiveCampaign, Inc. 1 N Dearborn, 5th Floor Chicago, Illinois 60602, USA. ActiveCampaign is certified under the Privacy Shield Agreement, which guarantees that it complies with the European level of data protection (https://www.privacyshield.gov/participant?id=a2zt0000000GnH6AAK&status=Active). The shipping service provider will be informed on the basis of our legitimate interests in accordance with Art. 6 Paragraph 1 lit. f. GDPR and an order processing contract in accordance with Art. 28 para. 3 sentence 1 GDPR.

The dispatch service provider may use the data of the recipients in pseudonymous form, i.e. without being assigned to a user, to optimise or improve its own services, e.g. to technically optimise the dispatch and presentation of the newsletters or for statistical purposes. However, the dispatch service provider does not use the data of our newsletter recipients to write to them or to pass the data on to third parties.

Newsletter – Measuring our Performance

The newsletters contain a so-called “web-beacon”, i.e. a pixel-sized file that is retrieved from our server when the newsletter is opened. Within the scope of this retrieval, technical information such as information on the browser and your system, as well as your IP address and time of retrieval are initially collected.

This information is used for the technical improvement of the services based on the technical data or the target groups and their viewing behaviour based on their retrieval locations (which can be determined by the IP address) or the access times. Statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is not our intention to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

Reach Measurement with Matomo

Within the scope of Matomo’s coverage analysis, the following information is collected on the basis of our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offer in the sense of Art. 6 Par. 1 lit. f. GDPR) the following data is processed: the type of browser and browser version you use, the operating system you use, your country of origin, date and time of the server request, the number of visits, your time spent on the website and the external links you have activated. The user’s IP address is made anonymous before it is saved. Matomo uses cookies, which are stored on the user’s computer and which enable an analysis of the use of our online offer by the users. Thereby pseudonymous user profiles of the users can be created from the processed data. The cookies have a storage period of one week. The information generated by the cookie about your use of this website is only stored on our server and is not passed on to third parties. Users can object to the anonymous data collection by the Matomo program at any time with effect for the future by clicking on the link below. In this case, a so-called opt-out cookie will be stored in your browser, which means that Matomo will no longer collect any session data.
